Possible encroachment into public land — Parcel 445
Between the private plots and the street runs Parcel 445, a public strip with a registered area of 562 sq m that is not part of the plots approved for construction. On 4 September 2026 residents measured the strip at its centre: from the northern boundary of Parcel 405 to the road edge — 6.10 metres; and from that point to the trunk of a tree in the first row of the lawn — 7.50 metres. The trunk therefore stands about 1.40 metres south of the road edge, well inside the lawn within Parcel 445. The width matches what the registered area implies (562 sq m ÷ 87 m of frontage ≈ 6.46 m). Photographs of the measurement are attached as Appendix A5.
The practical conclusion: most of the trees in that row are planted on public land, not within Parcels 443 and 444. Any relocation, felling or harm to them is no longer a matter between a developer and his own plot — it is harm to public space, requiring separate examination and separate approvals from the landowners and from the Forest Officer. We ask for confirmation that the works, the parking apron and the entrance do not extend into Parcel 445, and by what proprietary right it would be used.
Permit validity and grounds for lapse
Permit 20200513 (Parcel 444) was issued on 12 July 2022 and, by its own wording, “shall lapse three years from the date of issue” — that is, by 12 July 2025. It was in fact extended until 12 July 2028, bringing the permit to six years: the absolute maximum allowed under Regulation 59(a) of the Planning and Building (Building Licensing) Regulations, 2016, which permits extension “for special reasons to be recorded”.
Regulation 59(c) provides that a permit lapses if work does not begin within one year of issue, and Regulation 59(d) provides for lapse if work stops for more than a year. The permit was issued in July 2022 and some three years passed before any activity began on site. To this day no real construction has been carried out, and the only activity observed is fencing of the plot. We ask the Local Committee to examine whether the conditions for lapse under Regulation 59 were met, and on what “special reasons” the permit was extended to 2028.
Paying a fee does not cure a legal bar
The extension may have been accompanied by a renewal fee of about 10% of the original permit fee. However, Regulation 60(b) states expressly: “a permit shall not be renewed or extended if there is a legal bar to granting the permit at the time of its renewal or extension”. Paying the fee does not relieve the Committee of its duty to examine, at the moment of extension, whether a new legal bar has arisen — including the public boundaries of Parcel 445, the value of the mature trees, and non-compliance with Section 6.9.
Breach of an express condition — the site sign
Among the permit conditions is the requirement: “a visible sign bearing the permit number and the builder’s name shall be posted at the construction site”. Our inspection found that only fencing works had begun and no sign had been posted. Its absence prevents the public from knowing who is carrying out the works, under which permit and at what scope, and undermines public oversight. If no sign has been posted as required, we ask that the works be deferred until the condition is met.
Section 6.9 of the plan — protecting mature trees
Section 6.9 of Plan 303-0071670 sets a binding framework: for trees to be preserved — netting and signage around the tree, a protective distance of at least one metre beyond the crown diameter, and supervision by a certified agronomist whose report is a condition for Form 4; for relocation and felling — a detailed plan, replacement plantings and payment of substitute value. Above all, the section provides that “a building permit conditioned on the uprooting or relocation of a tree shall require the approval of the Forest Officer”, and the permit itself repeats this. We ask that information on the Forest Officer’s approvals, if any exist, be made public before any works.
The right to a fresh examination
Under the case law, the Appeals Committee — as a planning body senior to the Local Committee — is competent to re-examine the Local Committee’s decision on its merits, including a fresh look at a permit. Where a permit has gone unrealised for years, and during that time circumstances on the ground have changed materially — the space consolidating as a community focal point, the identification of the full set of mature trees, and the discovery of the public boundaries of Parcel 445 — there is, in our view, ground to request a fresh examination before implementation proceeds. This is not a cancellation of building rights, but their realisation in a way that preserves the public asset.
